Terms and Conditions (boring)
Article 1 - Definitions
- Sleeping House Chutzpah: MIMI creative content BV located in Borger, Chamber of Commerce number 69239657.
- Recreational apartment: Holiday accommodation used for recreational purposes.
- Main Guest: the person with whom Slaaphuisje Chutzpah has entered into an agreement.
- Co-guest: person or persons also mentioned in the agreement.
- Guests: Main guest and/or any fellow guest(s) together.
- Third parties: other persons (not Guests)
Article 2 - Applicability
- These terms and conditions apply to all quotations, offers, work, orders, agreements and deliveries of services or products by or on behalf of Slaaphuisje Chutzpah.
- Sleeping House Chutzpah and the Main Guest may only deviate from these conditions if this has been agreed in writing.
- Slaaphuisje Chutzpah and the Guests expressly exclude the applicability of the general terms and conditions of the Guests or of others.
Article 3 - Prices
- Sleeping House Chutzpah uses prices in euros, including VAT and tourist tax, but excluding any other costs.
- Slaaphuisje Chutzpah may change the prices of its services and products on its website and in other communications at any time.
- Sleeping House Chutzpah and the Main Guest agree on a price based on the rates applicable at that time, subject to obvious errors.
- If additional costs arise due to a change in charges and/or levies and these additional costs directly relate to the Recreation Apartment, the Main Guest and/or the Co-Guest, these may be passed on to the Guests, even after the agreement has been concluded.
Article 4 - Execution of the agreement
- Sleeping house Chutzpah makes the holiday apartment at Eeserstraat 24, 9531 CM in Borger available for recreational purposes for the agreed period.
- The agreement will be implemented in consultation and after written agreement and payment of any advance payment by the Main Guest.
- The Main Guest is responsible for informing Fellow Guests and/or Third Parties, if applicable, of these general terms and conditions.
- The agreement ends after the agreed period.
Article 5 - Cancellation and interim termination
- In case of cancellation by the Main Guest before the start date of the stay, the Main Guest owes Slaaphuisje Chutzpah a certain amount: - Up to 4 weeks before the start date: 0% of the agreed price excluding tourist tax. - Within 4 weeks to 2 weeks before the start date: 30% of the agreed price excluding tourist tax. - Within 2 weeks to 1 week before the start date: 70% of the agreed price excluding tourist tax. - Within a week of the start date: 100% of the agreed price excluding tourist tax.
- Sleeping House Chutzpah reserves the right to cancel your booking without giving reasons up to one week before the start date of your stay. The full price will be refunded free of charge.
- Slaaphuisje Chutzpah has the right to terminate the agreement immediately and without refund in the following cases: - Guests do not follow the instructions of Slaaphuisje Chutzpah, or persons acting on behalf of Slaaphuisje Chutzpah, despite several warnings. - Guests cause a nuisance in, or near, the holiday apartment. - Guests commit an alleged criminal offence.
- If guests leave early after the start date of their stay, this will not result in a refund.
- In all cases, any transaction costs will be borne by the Main Guest.
Article 6 - Use by third parties
- Third parties are not permitted to use the Recreation Apartment and/or the associated grounds without written permission from Slaaphuisje Chutzpah.
Article 7 - Complaints
- Complaints from guests must be handled adequately and with the necessary urgency by Slaaphuisje Chutzpah, taking into account reasonableness and fairness.
Article 8 - Liability
- Sleephouse Chutzpah cannot be held liable for any damage suffered by Guests and/or Third Parties in the Holiday Apartment and/or the associated grounds. Guests and/or Third Parties indemnify Sleephouse Chutzpah from any such liability.
- Slaaphuisje Chutzpah is only liable for damage resulting from gross negligence or neglect.
- Any right of Guests and/or Third Parties to compensation from Slaaphuisje Chutzpah expires 12 months after the event from which the liability directly or indirectly arises. This does not exclude the provisions of Article 6:89 of the Dutch Civil Code.
Article 9 - Dissolution
- The Main Guest may cancel the agreement if Slaaphuisje Chutzpah is culpably in breach of its obligations, unless this breach does not justify termination due to its special nature or minor significance.
- If fulfillment of the obligations by Slaaphuisje Chutzpah is still possible, dissolution can only take place after Slaaphuisje Chutzpah is in default.
- Slaaphuisje Chutzpah may cancel the agreement with the Main Guest if the Main Guest does not fully or timely fulfil his obligations under the agreement, or if Slaaphuisje Chutzpah has become aware of circumstances that give it good reason to assume that the Main Guest will not fulfil his obligations.
Article 11 - Force Majeure
- In addition to Article 6:75 of the Dutch Civil Code, a shortcoming of Slaaphuisje Chutzpah by Guests cannot be attributed to Slaaphuisje Chutzpah in the event of force majeure.
- The force majeure situation in paragraph 1 also includes: - an emergency such as a civil war or natural disaster - default or force majeure of suppliers, delivery personnel or others - power, electricity, internet, computer or telecom disruptions - computer viruses - strikes - government measures - transport problems - bad weather conditions - work stoppages
- If a force majeure situation occurs as a result of which Slaaphuisje Chutzpah cannot fulfil one or more obligations to the Guests, those obligations will be suspended until Slaaphuisje Chutzpah can fulfil them.
- From the moment a force majeure situation has lasted for at least 30 calendar days, both the Main Guest and Slaaphuisje Chutzpah may cancel the agreement in writing in whole or in part.
- In the event of force majeure, Slaaphuisje Chutzpah is not obliged to pay any compensation to Guests, even if Slaaphuisje Chutzpah benefits from this.
Article 12 - Amendment of general terms and conditions
- Sleeping House Chutzpah may change these terms and conditions.
- Slaaphuisje Chutzpah may always implement changes of minor importance.
- Slaaphuisje Chutzpah will discuss any significant changes with the Main Guest in advance as much as possible.
- In the event of a significant change to the general terms and conditions, the Main Guest may terminate the underlying agreement.
Article 13 - Transfer of rights
- Guests may not transfer any rights under an agreement with Slaaphuisje Chutzpah to others without the written permission of Slaaphuisje Chutzpah.
- This provision applies as a clause with property law effect as in Article 3:83 paragraph 2 BW.
Article 14 - Consequences of nullity or voidability
- If one or more provisions of these terms and conditions prove to be null and void or voidable, this will not affect the remaining provisions of these terms and conditions.
- A provision that is null and void or voidable will in that case be replaced by a provision that comes closest to what Slaaphuisje Chutzpah had in mind when drawing up the conditions on that point.
Article 25 - Applicable law and competent court
- Dutch law applies to these general terms and conditions.
- The court in the district where Slaaphuisje Chutzpah is established has exclusive jurisdiction to hear any disputes between the Guest and Slaaphuisje Chutzpah, unless the law provides otherwise.
